Road Traffic Accident

their own. If you've been involved in a road traffic accident, you could be eligible to make

If you were involved in a road accident as a:
Driver of a vehicle (i.e. van, car, bus, lorry, bike/cycle, motorbike or motorcycle), and that accident was caused by another negligent driver
Passenger in a vehicle involved in a road traffic accident. The accident may have been caused by either the driver of the vehicle you were travelling with or by another driver
Pedestrian or a cyclist that was hit by another negligent motor vehicle
What if the driver that hit me was uninsured?
All motorists are required by law to have a valid insurance policy. This means that if
you are hurt by a third party motorist, you can pursue a road traffic accident claim against
them. However, if the negligent motorist was uninsured at the time of the accident, you can
still make a claim through the Motor Insurers Bureau (MIB). If the accident involved a stolen
vehicle, or was a hit and run, you can make a claim against the vehicle owner's insurance
company, or through the MIB.

What do I pay if my case is successful?
If your solicitor wins your case, then typically, customers pay fees of 25% including VAT of the compensation amount that is recovered. Please note that this may be subject to your individual circumstances and the actual fee may be more or less than this. You may be required to pay an additional fee for other costs such as after-the-event (ATE) insurance.
Is there any other way I can make a claim?
Minor road traffic accidents:
If you have a minor personal injury claim as a driver or passenger in a road traffic accident that was not your fault, you do not have to use the services of a claims management company to pursue your claim. You may be able to present the claim yourself for free, directly through the Official Injury Claim Portal.
Uninsured or untraced drivers; foreign-registered vehicles or accidents abroad:
If you have been involved in a road traffic accident and wish to make a claim against an uninsured or untraced driver; or if the accident was in the UK involving a foreign- registered vehicle; or if the claim involves a road traffic accident abroad, you do not have to use the services of a claims management company to pursue your claim. It may be possible for you to present the claim for free, directly with the Motor Insurance Bureau.
Criminal Injury Claims:
If you think you have a criminal injury claim, you do not have to use the services of a claims management company to pursue your claim. You can present the claim yourself, for free, directly to the Criminal Injuries Compensation Authority (CICA).
